These General Terms and Conditions of Use (hereinafter the “Terms”) constitute a contract between the user of the Site (hereinafter “the User”) and DIGIREACH SOLUTIONS.

The purpose of these Terms of Use is to define the conditions under which DIGIREACH SOLUTIONS makes the Website’s services and features available to the User.

By sending an email or subscribing to a service, the User fully and unconditionally accepts these Terms of Use. If the User does not accept all of these Terms of Use, he or she must not use the Site.

Description of Services

Through the Site, DIGIREACH SOLUTIONS provides Users with the following features:

  • Sending mail via standard (green) mail, certified mail, or registered mail with return receipt requested;

Access to Services

DIGIREACH SOLUTIONS is committed to complying with its obligations as a deployer under Regulation (EU) 2024/1689 (IA Act), particularly with regard to transparency and disclosure.

However, the User acknowledges that emails generated by artificial intelligence (AI) are generated algorithmically, based on the instructions and content provided by the User, and may result in emails that are erroneous, inaccurate, incomplete, outdated, contradictory, or misleading (“hallucinations”).

Accordingly, DIGIREACH SOLUTIONS expressly disclaims any warranty, commitment, or representation of any kind regarding AI-generated emails, including, but not limited to:

  • The accuracy, completeness, reliability, or timeliness of AI-generated email;
  • The originality of AI-generated correspondence as defined by the Intellectual Property Code;
  • The absence of infringement of third-party rights or the absence of similarity to preexisting works protected by intellectual property rights;
  • The AI-generated content complies with applicable laws and regulations and, in particular, does not contain content that is violent, offensive, discriminatory, defamatory, harassing, pornographic, or child pornographic, or that incites any of these acts;
  • The suitability of AI-generated text for a specific purpose or expected outcome.

The User acknowledges and agrees that he or she is solely responsible for verifying any email generated by the AI before sending it to a recipient. DIGIREACH SOLUTIONS shall not be held liable for any email generated by the AI, whether or not it has been modified by the User.

Intellectual property

The Website, including all content published on it (text, images, photos, graphics, logos, files, databases, videos, source code, software, architecture, and design), is protected by the Intellectual Property Code and, more specifically, by copyright law.

Similarly, any trademarks that may appear on the Site are registered and protected by the Intellectual Property Code, specifically by trademark law.

Any representation and/or reproduction, in whole or in part, of the Website and the DIGIREACH SOLUTIONS trademarks, of any kind whatsoever, without the express, prior, written authorization of DIGIREACH SOLUTIONS is prohibited.

Liability

The User acknowledges that he or she is solely responsible for his or her use of the Site. Finally, DIGIREACH SOLUTIONS shall not be held liable in the event of force majeure, as defined in Article 1218 of the Civil Code and by the case law of the Court of Cassation, that has prevented it from fulfilling its obligations under the Terms of Use.

Governing Law – Dispute Resolution

These Terms of Use are governed by English law (the law of England and Wales), to the exclusion of any other law, even if the User is a foreign national and/or the Terms of Use are performed in whole or in part abroad.

However, the application of English law shall not have the effect of depriving the User of the protection afforded to him or her by the mandatory provisions of the law of the country in which he or she has his or her habitual residence, from which no contractual agreement may derogate. In such a case, the aforementioned mandatory provisions shall apply notwithstanding the choice of English law, to the extent necessary to ensure that the User receives the level of protection afforded by those provisions.

If, within thirty (30) calendar days of notification to DIGIREACH SOLUTIONS, the Parties have not reached an amicable agreement, each Party shall regain its full freedom of action.

THE COURTS OF ENGLAND AND WALES SHALL THEN HAVE EXCLUSIVE JURISDICTION TO HEAR ANY DISPUTE BETWEEN THE PARTIES REGARDING, AMONG OTHER THINGS, THE FORMATION, PERFORMANCE, INTERPRETATION, TERMINATION, OR RESCISSION OF THE TERMS OF SERVICE, INCLUDING PROCEEDINGS FOR PRELIMINARY INJUNCTIONS, EMERGENCY PROCEEDINGS, INTERLOCUTORY PROCEEDINGS, THIRD-PARTY JOINDER, MOTIONS, OR MULTIPLE DEFENDANTS.
